一、单个海员的免赔额是多少？
单个海员的免赔额为12,500美元。
根据Skuld P&I Rules 2026 Appendix 4– Deductibles 附录4 – 免赔额
“1.1. For Rules other than those referred to in paragraphs 1.2 to 1.6: USD 12,500
1.1. 除第1.2条至第1.6条所涉规则外：12,500美元”
（免赔额条款）， crew（船员）类别的免赔额标准为 USD 12,500。
需要特别注意的是：
1、免赔额由船东承担，不由海员承担。P&I保险承保的是船东对第三方的责任，免赔额是船东在向协会索赔前需自行承担的部分。海员作为被保障的第三方，其应得的赔偿金额不应因免赔额的存在而被扣减。
2、免赔额按“每一事件”（per event）计算，而非按每一海员。Appendix 4第3.1条明确，免赔额适用于“any one event any one vessel any one category”【Appendix 4, 3.1】。也就是说，同一起事件中若有多名海员受伤，船东只需承担一个免赔额（12,500美元），而非每人一个免赔额。
二、能否及如何扣减社保待遇赔偿？
（一）Skuld规则层面
Skuld P&I Rules 2026并未规定可以从赔偿中扣减海员已获得的社会保险待遇。规则中没有任何条款授权船东或协会因海员已获社保而减少赔偿金额。
（二）中国法层面：原则上不能扣减
根据《中华人民共和国民法典》第1179条，侵权人应当赔偿医疗费、护理费、残疾赔偿金等全部合理费用。
中国司法实践的主流观点是：
社会保险与侵权赔偿属于不同法律关系。医保报销是受害人与社保机构之间的行政/合同关系，侵权赔偿是侵权人与受害人之间的民事责任关系，二者不能相互抵扣。
社保不能减轻侵权人的责任。侵权人的侵权责任不因受害人获得社会保险而减轻或免除。
医保报销部分不应从赔偿中扣减。将已报销的医疗费从赔偿中扣除，会降低侵权人的违法成本，不符合法律精神。
（三）例外：医疗费不双重赔偿
唯一的例外是医疗费——如果社保已报销医疗费，受害人不能就同一笔医疗费再次向侵权人主张。但残疾赔偿金、误工费、护理费等其他赔偿项目，社保待遇与侵权赔偿可以兼得。
三、与我国民法典的扣减制度是否冲突？
Skuld规则本身未规定社保扣减，因此不存在与《中华人民共和国民法典》的直接冲突。
如果船东或协会在实践中试图以海员已获社保为由扣减赔偿，则与《中华人民共和国民法典》第1179条及中国司法实践相冲突：
中国法院普遍认为，侵权人不能因受害人获得社保而减轻赔偿责任。
社保机构可向侵权人追偿已支付的医疗费，但这是社保机构与侵权人之间的关系，不改变侵权人对受害人的全额赔偿责任。
四、哪些是“一致的抵扣”？（即中国法允许的扣减）
在中国法下，以下情形可能构成合法的抵扣：

五、律师费是否由船东承担？能否按小时收费？
（一）律师费是否由船东承担？
在特定条件下，由船东承担，最终由Skuld协会赔付。
根据Skuld P&I Rules 2026“Rule 25（Legal and associated costs）25. 法律及相关费用
标准保险承保与covered claims 相关的、合理发生的法律及附带费用，前提是这些费用是与协会协商一致的【“25.1. Cover 25.1. 承保范围 The standard insurance shall cover legal and associated costs reasonably incurred, in agreement with the Association, in relation to claims for which the member is covered under these Rules. 标准保险应涵盖成员根据本规则获得保障的索赔相关、经协会同意而合理产生的法律费用及相关费用。”】。
协会还可酌情承保与船舶事故正式调查相关的合理法律费用【“
25.2. Discretionary cover 25.2 酌情承保 The Association may cover, in whole or in part, in its absolute discretion, legal and associated costs reasonably incurred in connection with a formal enquiry into a casualty involving the entered vessel.本协会可全权酌情全部或部分承担与对入保船舶发生的事故进行正式调查相关的合理产生的法律及相关费用。”】。
此外，Defence cover（Rule 27） 专门承保与船舶运营直接相关的争议的合理法律协助费用，包括：
船员雇佣合同纠纷【27.1.4】
人身伤害或死亡【27.1.13】
货物运输、租船合同等【27.1.1】【27.1.6】
重要前提：船东必须事先获得协会批准才能指定律师，否则协会不承担费用【27.2.9】。
（二）能否按小时收费？
Skuld规则未明确规定律师费的计费方式，但实践中通常遵循以下原则：
“合理费用”（reasonable costs）标准：Rule 25和Rule 27均使用“reasonably incurred”或“reasonable costs”的表述，意味着费用必须合理【25.1】【27.1】。
按小时收费是行业常见做法：在海事争议中，律师按小时计费是通行做法，只要费率合理，协会通常会予以认可。
协会拥有裁量权：协会可基于“争议金额与费用之间是否合理”、“胜诉前景与费用是否合理”等标准，决定是否承保相关费用【27.2.11】。
