财政部国家海洋局关于调整海域使用金免缴审批权限的通知
(财综〔2013〕66号)
辽宁、河北、天津、山东、江苏、上海、浙江、福建、广东、广西、海南省（自治区、直辖市）财政厅（局）、海洋与渔业厅（局），大连、青岛、宁波、厦门、深圳市财政局（委）、海洋与渔业局：
2006年以来，财政部、国家海洋局先后印发了《海域使用金减免管理办法》（财综〔2006〕24号）、《关于海域使用金减免管理等有关事项的通知》（财综〔2008〕71号）等文件，进一步明确和细化了海域使用金依法免缴的政策和审批程序，各级财政部门、海洋行政主管部门认真贯彻落实，规范了海域使用金免缴行为，但也存在审批程序过于繁杂等问题。根据国务院转变政府职能简政放权的要求，为进一步提高工作效率，方便用海单位和个人，决定调整海域使用金免缴审批权限。现就有关事宜通知如下：
一、调整海域使用金免缴审批权限
（一）将用海单位和个人申请免缴国务院批准项目用海的海域使用金，按中央和地方分成，分别报财政部、国家海洋局和省、自治区、直辖市、计划单列市财政部门、海洋行政主管部门审查批准，调整为报财政部、国家海洋局审查批准。同时，财政部、国家海洋局将批准免缴海域使用金文件抄送项目用海所在地省级或者计划单列市财政部门、海洋行政主管部门以及财政部驻当地财政监察专员办事处备查。
（二）将用海单位和个人申请免缴地方各级人民政府批准的项目用海海域使用金，按中央和地方分成，分别报财政部、国家海洋局和省、自治区、直辖市、计划单列市财政部门、海洋行政主管部门审查批准，调整为报省、自治区、直辖市、计划单列市财政部门、海洋行政主管部门审查批准。同时，省、自治区、直辖市、计划单列市财政部门、海洋行政主管部门应将批准免缴海域使用金文件报财政部、国家海洋局备案，并抄送财政部驻当地财政监察专员办事处备查。其中，计划单列市财政部门、海洋行政主管部门批准免缴海域使用金文件同时报相关省财政部门、海洋行政主管部门备案。
（三）养殖用海单位和个人申请免缴海域使用金，继续由批准项目用海的地方人民政府财政部门、海洋行政主管部门审查批准。
二、建立海域使用金免缴台账
各级财政部门、海洋行政主管部门应当建立海域使用金免缴台账，逐笔记录项目用海名称、用海类型、用海面积、免缴金额、批准免缴海域使用金的依据、批复时间等信息，并汇总年度海域使用金免缴信息，报上级财政部门、海洋行政主管部门。各级海洋行政主管部门应当同时在国家海域动态监视监测管理系统中录入海域使用金免缴信息，在年度海域使用公报中向社会公布，自觉接受社会监督。
三、加强海域使用金免缴的监督管理
各级财政部门、海洋行政主管部门要严格按照《海域使用管理法》第三十五条、财综〔2006〕24号文件、财综〔2008〕71号文件审批海域使用金免缴事项，不得违反规定批准免缴海域使用金。同时，要自觉接受各级审计机关的审计和监督。对于违反规定批准免缴海域使用金的行为，依照《财政违法行为处罚处分条例》、《海域使用管理违法违纪行为处分规定》等相关规定，责令改正，补收应当缴纳的海域使用金，并追究相关单位和人员的责任。
本通知自2013年7月1日起执行。财综〔2006〕24号文件、财综〔2008〕71号文件有关规定与本通知不一致的，一律以本通知规定为准。
